Who has to take action?

An account on the Fuel Platform must be created only by entities that fulfil reporting and information obligations towards the President of the Energy Regulatory Office (URE), as set out in Article 4ba(1), Article 43d(1) and Article 43e(1) of the Act of 10 April 1997 - the Energy Law (Journal of Laws of 2022, item 1385, as amended).

IMPORTANT!!! ENTITIES THAT:
A)   ONLY BUY AND SELL FILLED LPG CYLINDERS,
B)   SELL FUELS ONLY THROUGH FUEL CARDS
ARE NOT REQUIRED TO CREATE AN ACCOUNT ON THE FUEL PLATFORM

From 1 July 2023, all the reporting and information obligations referred to above - performed by companies holding a WPC, OPC, OPZ, MPC or PPC licence and by entities entered in the Register of Importing Entities - will be fulfilled solely through the Fuel Platform system.

The obligation to create an account on the Fuel Platform therefore also applies to companies submitting to the President of URE information on the liquid fuel infrastructure used in their business. From 1 July 2023 this information may be submitted only through the Fuel Platform. That is why it is so important to create a user account on the Fuel Platform in advance.

IMPORTANT!!! A USER ACCOUNT ON THE PLATFORM WILL BE CREATED BY THE GOVERNMENT STRATEGIC RESERVES AGENCY (RARS) ONCE IT RECEIVES THE DOCUMENTS DESCRIBED BELOW:

A. Entrepreneurs who will act on the Fuel Platform themselves (sole traders, and partners or management board members authorized to represent the company individually) are not required to appoint an attorney.

These are:

• in the case of a business entered in CEiDG - the owner, or a partner in a civil law partnership authorized to represent the entity individually;
• in the case of entities registered in the KRS - a management board member     or partner authorized to represent the entity individually.

For such persons it is necessary to COMPLETE AND SEND THE ORIGINALS (PAPER VERSION) OF THE FOLLOWING DOCUMENTS, available at www.rars.gov.pl - Platforma Paliwowa:

1.   a completed declaration (RARS template) specifying the scope of authorization to act on the Fuel Platform; HERE YOU MUST PROVIDE AN EMAIL ADDRESS (as the basis for the account), A TELEPHONE NUMBER, THE COMPANY ADDRESS AND NAME, TICK THE PERMISSION LEVEL - URE_P3 AND SIGN BY HAND

2.   the RARS data protection notice (RARS template) - SIGN BY HAND

3.   a current extract from CEiDG or the KRS, or another document confirming the legal form; PRINTED ON THE DAY THE LETTER IS SENT.

B. Entrepreneurs who will act on the Fuel Platform through an authorized representative will need to submit in paper form:

1. the power of attorney (RARS template), signed in accordance with the     entrepreneur's rules of representation
2. a current extract from CEiDG or the KRS, or another document confirming the legal form; PRINTED ON THE DAY THE LETTER IS SENT
3. a completed     declaration (RARS template) specifying the scope of authorization to act on the Fuel Platform; HERE YOU MUST     PROVIDE THE ATTORNEY'S EMAIL ADDRESS (as the basis for the account), A TELEPHONE NUMBER, THE COMPANY ADDRESS AND NAME, TICK THE PERMISSION LEVEL - URE_P3 AND SIGN BY HAND;
4. the RARS data protection notice (RARS template) - SIGN BY HAND
5. proof of payment of the stamp duty on the power of attorney (PLN 17) to the account:
   Centrum Obsługi Podatnika, ul. Obozowa 57, 01-161 Warszawa, account number 21 1030 1508 0000 0005 5000 0070 

Where more than one power of attorney is granted, for example for several employees, the above documents, including the stamp duty, must be submitted in a number corresponding to the number of authorized attorneys.

Scope of the power of attorney

This information is addressed primarily to entities holding a licence to trade in liquid fuels (OPC), operating with the use of technical infrastructure, and to entities commissioning transport services to the end customer. In the vast majority of such cases, the scope of authorization to be indicated in the power of attorney will therefore be: Permission level URE_P3.

In every case, however, the scope of activity should be verified, also with regard to other reporting obligations arising from ACTS OF LAW (within the remit of RARS). 

IMPORTANT!!! In the document Scope of authorization it is necessary to provide the full and exact name of the entrepreneur together with the tax identification number (NIP), the first name and surname of the user or attorney, the telephone number of the user or attorney and the email address of the user or attorney.

Additional information.  Summary.

Once the above documents have been received and verified, RARS will create a user account and provide the authorized persons with the account and the logins to operate it. This may take up to several working days.

Creating an account will be a prerequisite for using the Fuel Platform.

The documents indicated must be submitted by post only, as originals, to the RARS address. It is not possible to submit these documents through electronic communication channels, including with the use of electronic or qualified signatures.

Information and reports already submitted to URE remain valid; there is no need to submit them again.

PERSONS ENTERING DATA INTO THE FUEL PLATFORM MUST HAVE:  

• ‍AN ELECTRONIC SIGNATURE - SZAFIR (THE SZAFIR SDK EXTENSION AND THE SZAFIR HOST APPLICATION MUST BE ENABLED TO WORK WITH THE SYSTEM) OR
• ‍AN E-ID CARD OR‍
• A TRUSTED PROFILE
